Abstract

The aim of the article is to examine the conditions under which human rights are not fully respected for all human beings. Specifically, it studies the relationship between being a subject of justice and the possession of a citizenship status and, on the other hand, the relationship between privation of rights and absence of citizenship. In this regard, some of the discourses that have allowed the caesura between man as a political subject and man
as a biological substrate are explored. We will take the deep intimacy between access to rights and the subject recognized by the State as the explanatory vector of the lack of protection of human rights.
