Abstract

The publishing and implementation of the Motu proprio Mitis Iudex Dominum Iesus, that describes the reform in the canonical process for the Declaration of the Nullity of marriage involves not only changes directly concerning the dynamic of the process, but also providing innovative elements related to the building of the case. This article is divided in three different parts: the first part exposes the background and context, in which the reform is framed, with specific references from Evangelii Gaudium, the Pontifical Commission for the reformation of the process and the Synod of Bishops, to conclude with the post-synodal Exhortation Amoris Laetitia. In the second part, I will focus in two of the aspects that have caught my attention: the called pre-trial phase and the brevior process, highlighting some aspects about praxis. Finally, I will present some considerations about the reception and problems concerning the implementation of the reform during the last few years since its implementation.
