Abstract

The Arellano Cedillo Judgment resolves a case of considerable historical and legal complexity with canonical rigor. Its most significant contribution is the clarification that the full incorporation of a parish into a religious institute does not imply a transfer of ownership of parish property, and that therefore a religious parish priest who donates such property to his own institute without the Ordinary’s permission acts with radical nullity in accordance with canons 1281, 1291, and 1292.
