Abstract
This work responds to three questions. In the first place, «Where are we?», on the one hand, the bishop, as a legislator, and the diocesan tribunals, and, on the other hand, the reason for the Motu Proprio Mitis Iudex. In a second time, entitled «Which way?», it exposes what Mitis Iudex says of the diocesan bishop as a judge. And, finally, there are some features of the episcopal response to these demands
