THE DIFFICULT EXECUTION OF AN ECCLESIASTICAL DECREE FUNDAMENTAL ASPECTS OF THE LEGAL CONFLICT BETWEEN THE DIOCESES OF BARBASTRO-MONZÓN AND LÉRIDA ON ARTISTIC GOODS

The author makes a brief reference to the long history of a conflict that began in the 19th century, and to a long legal-ecclesiastical history that began in 1995 and has not yet ended in the civil judicial process. It is hardly conceivable a case in which, in an intra-ecclesial matter, the Church cannot enforce its
own decisions according to its internal hierarchy, in which the State does not interfere. The main merit is to have been able to obtain an enforceable civil sentence, since the bishops of Barbastro-Monzón and Lérida arrived in their dioceses with an inherited conflict and to which their predecessors, although they tried to resolve amicably but uselessly, did not dare to undertake by the only possible effective way left. A conflict that, with a sentence handed down in the first instance and its provisional execution, enters a new phase that can lead to its final solution after a long journey of more than 25 years.
